This Privacy Notice is applicable to customers of BabyBjörn, including current, former, potential customers, users and recipients of a product offered by us, and visitors to our official websites and official social media accounts.

BabyBjörn cares about your privacy and your personal integrity, which we actively work to protect.

In this document, we describe how we handle your personal data and the purposes for which we use your personal data, as well as which lawful basis we rely on and which measures we take to protect personal data. We also provide information about how you exercise the rights you have in relation to our processing of personal data.

BabyBjörn AB (“BabyBjörn”, “we”, “us”, “our”) is the Data Controller for all data that is collected and processed by BabyBjörn. If you provide personal data to a third party, such as a retailer or an online marketplace, that retailer or online marketplace will be responsible for your personal data instead.

This privacy notice provides information about how we handle personal data when you communicate with us or visit our websites. When we talk about our “websites”, we mean www.babybjorn.com.au and the other websites we own and operate.

Depending on your interaction with us, we process your personal data for various purposes. To be able to manage your deliveries, returns, refunds, claims and warranty matters in a secure and effective manner, and to be able to notify you of the details and the status of such matters.

To be able to request your participation in customer and product surveys based on your recent purchase.

Lawful basis: When making products available to you, we will process your personal data necessary for fulfilment of a contract with you and to fulfil any obligations derived from that contract, whether the contract refers to a purchase order and payment, or the use of other services provided by us or by third parties. When you need to make a return or claim a consumer right, we will process your personal data to fulfil obligations derived from concluding a contract with us, whether the contract refers to a purchase transaction, or the use of other services provided by us or by third parties. For any other purpose referred to herein, the processing of your personal data is based on our legitimate interest as a business.

Retention time: We will keep and process your personal data for no longer than necessary for us to perform our contractual and consumer obligations.

To be able to manage your questions, handle complaints, warranty matters and registrations, order tracking, refunds, returns and to provide technical support, as well as to improve customer experience.

To be able to contact you, if necessary, via email, telephone, social media or any other means in response to your enquiries.

·       User-generated content, i.e. information that you provide during a customer service matter, for example photos or videos.

·       To resolve your case, we may also need to access and use transaction data, such as order, payment and delivery information.

Lawful basis: The processing of your personal data to provide you with the best possible customer service is based on both our legitimate interest as a business and the fulfilment of our contractual obligations to you.

Retention time: We will keep your data for as long as necessary to be able to support you regarding your case and to be able to handle potential legal claims from you as a customer. We may continue to keep and use your data if we have outstanding obligations to you or are prevented from erasure for any other reasons.

Please note that by hash-tagging your picture or video clip, you voluntarily share the content and other personal data with Instagram or other social media platforms. This relationship is outside of BabyBjörn’s control, and is a matter between you and the social media service provider.

Minors

We do not collect any personal data directly from minors on our websites. If we discover that any such information is in our possession, we will delete it.


Where and with whom do we share your personal data?

Your personal data is available and accessible only by those who need the data to accomplish the intended processing purpose. We may share your personal data within the BabyBjörn Group, with sub-contractors, partners and other third parties whenever necessary to fulfil the intended processing purpose.

The personal data that we collect from you is processed in your country or within a country in the European Union or the European Economic Area (“EU/EEA”) but may also, whenever necessary, be transferred to and processed in a country outside the EU/EEA. Any such transfer of your personal data will take place only if permitted and carried out in compliance with applicable laws, without undermining your statutory rights. Security of your personal data

At BabyBjörn, we ensure that your personal data is handled according to specific security measures to protect the personal data from unlawful or unauthorised access to the information. At BabyBjörn, only the information needed is handled, and only by those who need it, to provide the best service to our customers.


Your rights

You are the one in control of your personal data, and we always strive to ensure that you can exercise your rights as efficiently and smoothly as possible.  

Access – You always have the right to receive information about the processing of data that concerns you. We will only provide information if we have been able to verify that you are the one requesting that information.  

Rectification – If you discover that the personal data we are processing about you is incorrect, please let us know and we will fix it!  

Erasure – Do you want us to completely forget about you? You have the right to be forgotten and request erasure of your personal data when the processing is no longer necessary for the purpose for which it was collected. If we are required to retain your information under applicable law or a contract that we have entered with you, we will ensure that it is processed only for the specific purpose set forth in such applicable law or contract. We will thereafter erase the information as soon as possible.  

Objections – Do you disagree with our assessment that our legitimate interest in processing your personal data overrides your interest in protecting your privacy? Don't worry – in this case, we will review our legitimate interest assessment. Of course, we add your objection to the balance and make a new assessment to see if we can still justify our processing of your personal data. If you object to direct marketing, we will immediately delete your personal information without making an assessment.  

Restriction – You can also ask us to restrict our processing of your personal data.  

●     Whilst we are processing a request from you to exercise any of your other rights;

●     If, instead of requesting erasure, you want us to limit the processing of personal data for a specific purpose. For example, if you do not want us to send advertising to you in the future, we will still need to save your name in order to know that we should not contact you; or

●     in cases where we no longer need the information in relation to the purpose for which it was collected, provided that you do not have an interest in retaining it to make a legal claim.

Data portability – We may provide you with the data that you have submitted to us or that we have received from you in connection with a contract that we have entered with you. You will receive your information in a commonly used and machine-readable format that you can transfer to another personal data manager.  

Withdraw consent – If you have given consent to one or several specific processing(s) of your personal data, you have the right to withdraw your consent at any time and thus ask us to terminate the processing immediately. Please note that you can only withdraw your consent for future processing of personal data and not for processing that has already taken place.

Right to complain to a supervisory authority:

If you have a complaint about the way BabyBjörn Group is processing and protecting your personal data and privacy, you have the right to make a complaint to the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten – IMY) or any other competent supervisory authority in your country of residence.


Changes to this notice

We reserve the right to make changes to this Privacy Notice. In the event that the change affects our obligations or your rights, we will inform you about the changes in advance so that you are given the opportunity to take a position on the updated notice.
